These Terms and Conditions (the "Terms") govern access to and use of ASkillfulDriver.com, related student portals, communications, and online services (collectively, the "Services") operated by CyberActive, Inc., doing business as A Skillful Driver ("A Skillful Driver," "we," "us," or "our"). By accessing the Services, creating an account, purchasing or beginning a course, or electronically accepting an enrollment agreement, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Courses Covered by These Terms
These Terms apply to the following Ohio online courses and related services offered through A Skillful Driver:
- Ohio Teen Driver Education ("Teen Course");
- Ohio Abbreviated Adult Driver Education ("Abbreviated Adult Course"); and
- Ohio Limited Term Driver Education ("Limited Term Course").
Course availability, eligibility, curriculum, time limits, examination rules, identification procedures, fees, certificate procedures, and other requirements may differ by course and may change when Ohio law or Ohio Department of Public Safety ("Ohio DPS") requirements change.
2. Eligibility and Course Selection
You are responsible for selecting the course that applies to your age, licensing status, test history, permit or license type, and instructions from Ohio DPS, the Ohio Bureau of Motor Vehicles ("Ohio BMV"), a court, or another authority. Eligibility descriptions on the Services are general guidance and do not replace official instructions.
The Teen Course is intended for eligible beginning drivers completing Ohio's required classroom or online driver education. The Abbreviated Adult Course is intended for eligible adult applicants who must complete abbreviated training after an unsuccessful qualifying driving-test attempt. The Limited Term Course is intended for eligible applicants seeking an Ohio limited term license who must complete the 24-hour driver education requirement. Requirements outside the online classroom course, including a TIPIC, behind-the-wheel instruction, supervised driving, affidavits, testing, and BMV documentation, are the student's responsibility unless expressly included in a separate written agreement.
A Skillful Driver may refuse or cancel an enrollment when the selected course is not appropriate, required information is inaccurate or incomplete, the student is ineligible, or enrollment would violate applicable law or regulatory requirements.
3. Students Under 18 and Parent or Guardian Consent
A student under 18 may enroll and use the Services only with the involvement and legally required consent or signature of a parent or legal guardian. The parent or guardian is responsible for reviewing the applicable enrollment agreement, these Terms, and the Privacy Policy and for supervising the minor's compliance. The parent or guardian authorizes the collection, use, retention, and disclosure of student information as described in the Privacy Policy and as required to administer and document the course.
4. Enrollment Agreements Control Course-Specific Requirements
Each course may require a separate electronic training or enrollment agreement ("Enrollment Agreement"). The Enrollment Agreement is incorporated into these Terms and contains the course-specific price, refund and cancellation policy, administrative or reenrollment fees, completion deadline, training hours, certificate terms, and other disclosures required by Ohio law.
If these Terms conflict with an Enrollment Agreement, the Enrollment Agreement controls for that course. If an advertisement or checkout offer conflicts with the signed Enrollment Agreement, applicable law and the signed Enrollment Agreement control, except that we will honor a clearly stated promotional guarantee to the extent required by law.
5. Account Registration and Accurate Information
You must provide complete, current, and accurate information, including the student's legal name, date of birth, address, contact information, and any permit, license, parent, guardian, or eligibility information requested. Information used for certificates must match the student's official records. You must promptly correct errors before a certificate is issued.
You are responsible for safeguarding account credentials and security answers and for activity occurring through the account. Accounts are individual and may not be transferred or shared. Notify us promptly if you suspect unauthorized access.
6. Student Identity, Personal Completion, and Course Security
The enrolled student must personally complete all required lessons, activities, quizzes, authentication checks, and examinations. We may use knowledge-based questions, account credentials, device and session data, parent or guardian verification, public-record or third-party identity information, or other methods approved or required by Ohio DPS to confirm identity and course participation.
Cheating, impersonation, allowing another person to complete any portion of a course, sharing answers, bypassing timers or authentication, using automated tools to complete coursework, tampering with records, or providing false information is prohibited. Suspected circumvention may result in a lockout, investigation, course suspension or termination, withholding or voiding of a certificate, reporting to appropriate authorities, and loss of fees to the extent permitted by the applicable Enrollment Agreement and law.
7. Course Progress, Time Limits, and Examinations
Students must complete the course within the period stated in the applicable Enrollment Agreement. The Services may enforce daily instructional limits, minimum seat-time requirements, inactivity controls, module sequencing, security questions, examination limits, and other controls required by Ohio law or the approved course design.
A student completes a course only after satisfying all required instructional time, modules, activities, identity checks, and examinations. A passing course score does not guarantee passage of an Ohio BMV knowledge, maneuverability, or road test. Technical interruptions do not waive regulatory requirements. Contact customer support promptly if a technical issue affects course access or recorded progress.
8. Fees, Payments, Taxes, and Optional Services
Course prices and any optional charges are displayed during registration or checkout. You authorize us and our payment processors to charge the selected payment method for the amounts shown. Optional products or services, including practice materials, expedited processing or delivery, and replacement certificates, are charged only when selected or otherwise authorized. Applicable taxes and legally permitted fees may be added.
If a payment is reversed, disputed, declined, or fraudulent, we may suspend access and withhold optional services while the payment issue is investigated, subject to applicable law. Filing a payment dispute does not cancel regulatory records already created or remove obligations under the Enrollment Agreement.
9. Course-Specific Refunds and Cancellations
Refund and cancellation eligibility varies by course. The applicable Enrollment Agreement states the controlling deadline, conditions, deductions, administrative fees, reenrollment terms, and method for requesting a refund. Review that agreement before purchasing.
When a satisfaction guarantee is expressly displayed for a particular course, it applies only to that course and only under the conditions shown at registration. For example, a guarantee conditioned on cancellation before a Certificate of Enrollment is earned does not apply after that event and does not automatically apply to a course that does not issue that certificate. Unless an Enrollment Agreement or applicable law states otherwise, no refund is due after a completion certificate has been issued or when enrollment is terminated for fraud, cheating, impersonation, or material policy violations.
To request cancellation or a refund, contact iinfo@askillfuldriver.com or 1-866-749-4445 and provide the student's name, account email, course, and order information. Approved refunds are returned to the original payment method when reasonably possible.
10. Certificates, State Records, and Reporting
Certificates are issued only after successful completion and verification of all applicable course requirements. We issue certificates and maintain or transmit course records within the time and manner required by Ohio law and the approved course. "Issued" does not necessarily mean delivered by mail on the same date. Delivery times may depend on the method selected and third-party carriers.
We may provide enrollment, progress, completion, certificate, identity, and related records to Ohio DPS, Ohio BMV, an authorized driving school, a court or government agency, or another recipient as required by law or authorized by the student or parent or guardian. A Skillful Driver is not responsible for processing time or decisions by Ohio DPS, Ohio BMV, driving schools, courts, testing locations, mail carriers, or other third parties.
Requests for corrected, duplicate, lost, or stolen certificates are subject to identity verification, required forms, and any fee permitted by Ohio law and the applicable Enrollment Agreement.
11. Electronic Communications, Calls, and Text Messages
You consent to receive transactional communications about registration, security, course progress, deadlines, completion, certificates, payments, and customer support by email, telephone, or text message at the contact information provided. Consent to marketing communications is not a condition of purchase. Message frequency varies, and message and data rates may apply. You may opt out of marketing texts by replying STOP and may request help by replying HELP. Opting out of marketing does not prevent legally required or essential nonmarketing communications where permitted by law.
You agree that electronic signatures, disclosures, notices, records, and agreements satisfy legal writing and signature requirements to the extent permitted by law. Keep copies of your Enrollment Agreement, receipts, and course records.
12. Acceptable Use
You may use the Services only for lawful, personal, noncommercial course participation. You may not:
- copy, reproduce, publish, sell, sublicense, distribute, record, scrape, or create derivative works from course content except as law expressly permits;
- reverse engineer, probe, disrupt, overload, or attempt unauthorized access to the Services or related systems;
- upload malicious code, interfere with another student, or misuse customer-support channels;
- use false identities, stolen payment methods, bots, scripts, or automated course-completion tools; or
- use the Services in a way that violates law, Ohio DPS requirements, these Terms, or an Enrollment Agreement.
13. Intellectual Property
The Services and their course materials, text, graphics, videos, simulations, software, logos, trademarks, and other content are owned by or licensed to CyberActive, Inc. and are protected by intellectual-property laws. Subject to these Terms, we grant the enrolled student a limited, revocable, nonexclusive, nontransferable license to access the purchased course for personal educational use during the enrollment period. No ownership rights are transferred.
14. Third-Party Services and Links
The Services may rely on or link to third-party payment processors, identity-verification services, analytics providers, communication providers, government websites, driving schools, maps, or other services. Third-party services are governed by their own terms and privacy practices. A link or integration does not mean we control or guarantee that service.
15. Accessibility and Accommodations
If you experience an accessibility barrier or need information about available accommodations, contact us before or during enrollment. We will work in good faith to address accessibility requests consistent with the approved course design, technical feasibility, and applicable law. An accommodation cannot waive a mandatory Ohio training, identity, testing, or completion requirement.
16. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DO NOT WARRANT THAT ACCESS WILL ALWAYS BE UNINTERRUPTED OR ERROR-FREE. COURSE COMPLETION DOES NOT BY ITSELF GUARANTEE A PERMIT, LICENSE, TEST RESULT, INSURANCE BENEFIT, COURT OUTCOME, OR ACCEPTANCE BY A PARTICULAR THIRD PARTY. NOTHING IN THESE TERMS EXCLUDES WARRANTIES OR RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED.
17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CYBERACTIVE, INC. AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST DATA, PROFITS, OPPORTUNITIES, OR LICENSE-RELATED DELAYS, ARISING FROM THE SERVICES. OUR TOTAL LIABILITY FOR A CLAIM ARISING FROM A COURSE WILL NOT EXCEED THE AMOUNT PAID FOR THAT COURSE. THESE LIMITATIONS DO NOT APPLY WHERE PROHIBITED BY LAW OR TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED.
18. Suspension and Termination
We may suspend or terminate access when reasonably necessary to investigate security concerns, payment fraud, identity issues, cheating, misuse, legal noncompliance, or threats to the Services or other users. When appropriate, we may provide an opportunity to correct an issue. Termination does not affect provisions that by their nature should survive, including payment obligations, intellectual-property rights, disclaimers, liability limitations, and recordkeeping duties.
19. Changes to the Services or These Terms
We may update the Services or these Terms to reflect legal, regulatory, operational, security, or course changes. The "Last updated" date identifies the current version. Material changes will be communicated as required by law. Changes will not retroactively reduce a student's rights under a signed Enrollment Agreement unless required by law or accepted by the student or parent or guardian.
20. Governing Law and Disputes
These Terms are governed by applicable federal law and the laws of the State of California, without limiting mandatory rights or requirements under Ohio law governing Ohio driver training or any consumer protection that cannot be waived. Before filing a legal claim, you agree to contact us and make a good-faith effort to resolve the concern informally. Nothing in this section prevents a student from contacting Ohio DPS, Ohio BMV, a consumer-protection agency, or another regulator, or from using a remedy that cannot legally be restricted.
21. General Provisions
If any provision is found unenforceable, it will be limited to the minimum extent necessary, and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not assign your account or rights under these Terms without our written consent. We may assign these Terms in connection with a merger, reorganization, sale, or transfer of the Services, subject to applicable law. These Terms, the Privacy Policy, the applicable Enrollment Agreement, and any written checkout terms form the agreement concerning the Services.
