CyberActive, Inc., doing business as A Skillful Driver ("A Skillful Driver," "we," "us," or "our"), respects your privacy. This Privacy Policy explains how we collect, use, retain, disclose, and protect personal information when you visit ASkillfulDriver.com, create an account, enroll in or complete a course, use a related student portal, contact us, or otherwise use our online services (collectively, the "Services").

1. Scope

This Policy applies to the A Skillful Driver website and the online services used for Ohio Teen Driver Education, Ohio Abbreviated Adult Driver Education, and Ohio Limited Term Driver Education. It also applies to related customer support, transactional communications, certificate processing, and regulatory records that we control.

This Policy does not govern independent driving schools, Ohio DPS, Ohio BMV, courts, government websites, payment providers, or other third parties that process information under their own policies, except when they act solely as our service providers.

2. Personal Information We Collect

Information You Provide

• Identity and contact information, such as legal name, date of birth, mailing address, email address, telephone number, and preferred language.
• Enrollment and eligibility information, such as selected course, age, licensing status, permit or license details, test history, and other information needed to determine or document course eligibility.
• Parent or guardian information for a student under 18, including name, contact information, relationship to the student, consent, and electronic signature.
• Account and authentication information, such as username, password, security questions and answers, electronic signatures, and information used to confirm student identity.
• Course and education records, such as login dates, time spent, progress, lesson activity, quiz and examination questions and responses, scores, attempts, instructor or support communications, security checks, completion status, and certificate information.
• Transaction information, such as purchases, selected options, billing address, payment status, refunds, chargebacks, and receipt details. Payment-card information is generally collected directly by a payment processor; we may receive a token or limited transaction information rather than the full card number.
• Communications and support information, including emails, calls, chats, text messages, survey responses, complaints, and information submitted with a request.
• Documents or other information voluntarily uploaded or sent to us, including information needed to correct records, verify eligibility, resolve an account issue, or request a duplicate certificate.

Information Collected Automatically

• Device and network information, including IP address, browser type, operating system, device identifiers, language, approximate location derived from IP address, and internet-service information.
• Usage information, including pages viewed, links selected, referring pages, session dates and times, course navigation, errors, and interactions with website or course features.
• Cookies and similar technologies used for sign-in, course progress, preferences, security, analytics, performance, and, where used, advertising measurement.

Information From Other Sources

• Identity, eligibility, or public-record information from approved verification providers or public databases when used to authenticate a student or satisfy Ohio requirements.
• Information from a parent or guardian, authorized driving school, government agency, payment provider, fraud-prevention provider, customer-support platform, or communication provider.
• Advertising or analytics information from business partners when permitted by law and consistent with your choices.

3. Sensitive Personal Information

Depending on the course and verification method, we may process information considered sensitive under certain laws, such as account login credentials, government-issued identification or permit information, precise identity-verification information, or information about a minor. We use sensitive personal information only as reasonably necessary to provide and secure the Services, verify identity and eligibility, satisfy Ohio driver-training requirements, prevent fraud, process certificates, and comply with law. We do not use sensitive personal information to infer characteristics about an individual for unrelated purposes.

4. How We Use Personal Information

• Register students, create and maintain accounts, provide course access, save progress, administer examinations, and issue certificates.
• Verify student and parent or guardian identity, age, eligibility, personal completion, and compliance with course-security requirements.
• Enforce instructional time limits, examination rules, completion deadlines, enrollment agreements, and other approved course requirements.
• Process payments, refunds, optional services, corrected records, and duplicate-certificate requests.
• Provide customer service, technical support, course reminders, security notices, and certificate or account communications.
• Maintain and disclose records required by Ohio law, Ohio DPS, Ohio BMV, audits, investigations, legal process, or other government requirements.
• Detect, investigate, and prevent fraud, impersonation, cheating, unauthorized access, technical abuse, and security incidents.
• Operate, troubleshoot, analyze, improve, and protect the website, courses, content, and business operations.
• Send marketing communications where permitted by law and consistent with your preferences. Marketing consent is not required to purchase a course.
• Establish, exercise, or defend legal rights and comply with applicable laws and regulatory obligations.

5. How We Disclose Personal Information

We may disclose personal information to the following categories of recipients for the purposes described in this Policy:

• Ohio DPS, Ohio BMV, authorized driving schools, courts, testing locations, law-enforcement agencies, or other government entities when required, permitted, or authorized for enrollment, training, certification, audits, investigations, or licensing.
• Service providers that support hosting, cloud storage, content delivery, course administration, payment processing, identity verification, fraud prevention, analytics, customer support, email, telephone, text messaging, document delivery, and security.
• A parent or legal guardian of a minor student and other persons the student or parent or guardian authorizes.
• Professional advisers, auditors, insurers, regulators, courts, or parties to legal proceedings when reasonably necessary to protect rights, safety, and property or comply with law.
• An acquiring or successor organization in connection with a merger, financing, reorganization, bankruptcy, sale, or transfer of some or all of our business or assets, subject to applicable law.
• Advertising or analytics partners when cookies or similar technologies are used and the disclosure is permitted by law and consistent with available privacy choices.

We may also disclose aggregated or deidentified information that cannot reasonably be linked to an individual, and we will not attempt to reidentify it except as permitted by law.

6. Sale and Sharing of Personal Information

We do not sell personal information for money. Some analytics or advertising technologies may involve disclosure of identifiers, device information, or internet activity that certain state privacy laws define as "sharing," "sale," or targeted advertising, even when no money is exchanged. Where applicable, you may opt out through the cookie-preference or "Your Privacy Choices" tool provided on the Services, by using a legally recognized browser opt-out signal such as Global Privacy Control where supported and required, or by contacting us as described below.

We do not knowingly sell or share the personal information of individuals under 16 for cross-context behavioral advertising without the authorization required by applicable law.

7. Cookies and Similar Technologies

We use cookies, pixels, local storage, session technologies, and similar tools to keep users signed in, preserve course progress, remember preferences, protect accounts, measure performance, diagnose errors, understand use, and support advertising or campaign measurement where enabled. Essential cookies are necessary for the Services to function and cannot always be disabled.

Browser settings may block or delete cookies, but doing so may prevent sign-in, authentication, saved progress, video playback, or other course functions. We do not currently respond to traditional browser "Do Not Track" signals. We process legally recognized opt-out preference signals, such as Global Privacy Control, when and to the extent required by applicable law and supported by our systems.

8. Communications and Marketing Choices

We may send transactional emails, calls, or text messages concerning registration, identity verification, security, course progress, deadlines, payments, completion, certificates, and support. These messages are part of providing the Services. Where required, we obtain consent before sending marketing messages. You may unsubscribe from marketing emails using the link in the message and may opt out of marketing texts by replying STOP. Your opt-out does not prevent nonmarketing communications permitted by law.

9. Data Retention

We retain personal information for as long as reasonably necessary for the purposes described in this Policy, including the student's enrollment and course-access period; certificate processing; customer support; accounting, tax, and payment records; security and fraud prevention; disputes; and the record-retention periods required by Ohio driver-training laws and regulators. Required student, examination, certificate, and business records may be retained after an account becomes inactive or a deletion request is received. When information is no longer required, we take reasonable steps to delete, deidentify, or securely dispose of it.

10. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information, including access controls and security measures appropriate to the nature of the information. No internet transmission, system, or storage method can be guaranteed to be completely secure. You are responsible for using a strong, unique password, protecting account credentials, and notifying us promptly of suspected unauthorized access.

11. Students Under 18 and Children Under 13

Our driver education Services are designed for individuals who meet the minimum age and eligibility requirements of the selected Ohio course. A student under 18 must enroll with required parent or legal guardian involvement. We may provide the parent or guardian access to information about the minor's enrollment, progress, payments, communications, and completion as permitted or required by law.

The Services are not directed to children under 13, and children under 13 are not eligible to create an account or enroll. We do not knowingly collect personal information online from a child under 13. If you believe a child under 13 has provided information to us, contact us so we can investigate and take appropriate action.

12. Your Privacy Rights

Depending on where you live and subject to legal exceptions, you may have the right to:

• request access to or confirmation of the personal information we process about you;
• request correction of inaccurate personal information;
• request deletion of personal information;
• obtain a portable copy of certain personal information;
• opt out of the sale or sharing of personal information, targeted advertising, or certain profiling;
• limit certain uses or disclosures of sensitive personal information where the right applies;
• withdraw consent for processing based on consent; and
• appeal a denied request and receive equal service without unlawful discrimination for exercising a privacy right.

These rights are not absolute. For example, we may retain or disclose information needed to complete a transaction, provide the course, maintain required Ohio driver-training records, protect security, prevent fraud, comply with law, or establish or defend legal claims.

13. How to Submit a Privacy Request

You or an authorized agent may submit a request by emailing iinfo@askillfuldriver.com, calling 1-866-749-4445, or using any privacy-request form or "Your Privacy Choices" link made available on the Services. Describe the right you wish to exercise and provide the name, account email, course, and other information reasonably needed to locate the record.

We may verify your identity or authority before completing a request. For a minor student, we may verify the requesting parent or legal guardian. Authorized agents may be required to provide signed permission or other legally sufficient proof of authority. We will respond within the period required by applicable law and explain any denial and available appeal process.

14. California Privacy Notice

If the California Consumer Privacy Act, as amended ("CCPA"), applies to CyberActive, Inc. and your information, the categories described in Section 2 are the categories of personal information we have collected during the preceding 12 months. We collect them from the sources described in Section 2, use them for the purposes in Section 4, and disclose them to the recipients in Section 5. The categories may include identifiers; customer-record information; characteristics protected by law, such as age; commercial information; internet or electronic network activity; approximate geolocation; audio or communication information; education-related records; inferences related to fraud or service use; and sensitive personal information such as account credentials or government identification information when required.

We do not sell personal information for money. Any disclosure treated as "sharing" for cross-context behavioral advertising is addressed in Section 6. We do not use or disclose sensitive personal information for purposes that require a right to limit beyond providing, securing, and administering the Services and complying with law. California residents may exercise applicable rights to know, access, correct, delete, opt out, limit, and receive nondiscriminatory treatment using the methods in Section 13.

15. Third-Party Links and Services

The Services may contain links to Ohio government sites, driving schools, social networks, or other third-party services. We are not responsible for the privacy, security, or content practices of independent third parties. Review their policies before providing information.

16. United States Processing

A Skillful Driver is operated in the United States, and personal information is processed and stored in the United States and in other locations where our service providers operate. If you access the Services from outside the United States, you understand that information may be transferred to jurisdictions with different data-protection laws, subject to applicable safeguards.

17. Changes to This Privacy Policy

We may update this Policy to reflect changes in law, regulation, technology, vendors, or our practices. The "Last updated" date identifies the current version. We will provide additional notice of material changes when required by law. If consent is legally required for a new use, we will request it.
